本利用規約（以下「本規約」）は、「ベイエリアビジネスハブ」（以下「本サービス」）の利用条件を定めるものです。

ユーザーは、本規約に同意の上で本サービスを利用するものとします。

1. 本サービスのご利用は 13 歳以上の方に限られます。13 歳未満の方はアカウントを作成することができません。
2. ユーザーは、正確かつ最新の情報を提供するものとします。
3. ユーザーは、自身のアカウント情報を適切に管理する責任を負います。
4. アカウントの不正使用による損害について、運営は責任を負いません。

1. 本サービスは、Google アカウントによるログイン機能を提供します。
2. ユーザーは、Google の利用規約およびプライバシーポリシーにも従うものとします。

本サービスは、ユーザー同士の交流および情報共有を目的としたコミュニティサービスです。

運営は、サービス内容の変更、追加、または停止を行うことができます。

ユーザーは、以下の行為を行ってはなりません。

• 法令に違反する行為
• 虚偽の情報の登録
• 他ユーザーへの嫌がらせ、誹謗中傷、差別的言動
• スパム、無断の広告・勧誘
• 知的財産権の侵害
• 不正アクセスまたはシステムへの干渉
• サービス運営を妨害する行為

1. ユーザーは、自らの責任においてコンテンツを投稿するものとします。
2. 投稿されたコンテンツの権利はユーザーに帰属します。
3. ユーザーは、本サービスに対し、投稿コンテンツをサービス内で表示・利用するための非独占的、世界的、無償のライセンスを付与します。本ライセンスは、コンテンツの削除またはアカウントの削除をもって終了します。運営は、本サービスの運営・改善以外の目的（商業的な再販、AI 学習データへの利用等）に投稿コンテンツを使用しません。
4. 運営は、規約違反または不適切と判断したコンテンツを削除することができます。

1. 本サービスでは、有料イベントへの参加に際して Stripe を通じた決済処理を行います。
2. 各イベントの返金ポリシー（返金可否および返金申請期限）は、イベント詳細ページに明記されます。
3. 返金を希望する場合は、各イベントに定められた期限内に contact@hellosake.com までご連絡ください。
4. 技術的な決済エラーが発生した場合は、運営が合理的な対応を行います。

運営は、以下の場合にユーザーのアカウントを停止または削除することができます。

• 本規約違反
• 不正利用またはその疑い
• その他、運営が合理的に不適切と判断した場合

緊急性のある場合（不正利用・セキュリティ上の脅威等）を除き、運営はアカウント停止前に合理的な通知を行うよう努めます。停止措置に異議がある場合は、contact@hellosake.com までお問い合わせください。

1. 本サービスは「現状有姿（AS IS）」で提供されます。
2. 運営は、サービスの正確性、有用性、継続性について保証しません。
3. ユーザー間のトラブルについて、運営は責任を負いません。

適用される法令の範囲内で、運営は、本サービスに関連して生じた間接的、付随的、特別、結果的損害について責任を負いません。

ユーザーは、本サービスの利用または本規約違反に関連して生じた第三者からの請求について、運営を補償するものとします。

運営は、事前の通知なく、本サービスの全部または一部を変更または終了することができます。

本規約は、必要に応じて変更される場合があります。

ユーザーの権利に重大な影響を与える変更（重要変更）を行う場合は、変更発効日の少なくとも 30 日前に本サービス上または登録メールアドレス宛に通知します。重要変更の発効後も継続してサービスを利用した場合、変更後の規約に同意したものとみなします。

本規約は、アメリカ合衆国カリフォルニア州法に準拠します。

本サービスに関連して生じた紛争は、カリフォルニア州サンタクララ郡の州裁判所または連邦裁判所を専属的合意管轄とします。

These Terms of Service (the "Terms") set out the conditions for using "Bay Area Business Hub" (the "Service").

By using the Service, users agree to these Terms.

1. The Service is available only to users who are 13 years of age or older. Users under 13 may not create an account.
2. Users must provide accurate and up-to-date information.
3. Users are responsible for properly managing their account credentials.
4. The operator is not liable for any damage caused by unauthorized use of an account.

1. The Service offers login via Google account.
2. Users must also comply with Google's Terms of Service and Privacy Policy.

The Service is a community platform designed for networking and information sharing among users.

The operator may modify, add to, or suspend the Service at any time.

Users must not engage in any of the following:

• Actions that violate applicable laws or regulations
• Registering false information
• Harassing, defaming, or discriminating against other users
• Spam or unsolicited advertising or solicitation
• Infringement of intellectual property rights
• Unauthorized access or interference with systems
• Actions that interfere with the operation of the Service

1. Users are solely responsible for content they post.
2. Rights to posted content remain with the user.
3. Users grant the operator a non-exclusive, worldwide, royalty-free license to display and use posted content within the Service. This license terminates upon deletion of the content or the user's account. The operator will not use posted content for purposes outside the operation and improvement of the Service (including commercial resale or AI training data).
4. The operator may remove content deemed to violate these Terms or otherwise inappropriate.

1. The Service uses Stripe to process payments for paid event registrations.
2. The refund policy for each event (whether refunds are available and the deadline to request one) will be stated on the event detail page.
3. To request a refund, please contact contact@hellosake.com within the deadline specified for the relevant event.
4. In the event of a technical payment error, the operator will make reasonable efforts to resolve the issue.

The operator may suspend or delete a user's account in the following cases:

• Violation of these Terms
• Unauthorized use or suspected unauthorized use
• Other cases the operator reasonably deems inappropriate

Except in urgent cases (e.g., fraud or security threats), the operator will make reasonable efforts to notify the user before suspension. If you believe a suspension was made in error, please contact contact@hellosake.com.

1. The Service is provided "AS IS".
2. The operator makes no warranties regarding the accuracy, usefulness, or continuity of the Service.
3. The operator is not responsible for disputes between users.

To the extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the Service.

Users agree to indemnify the operator against any claims by third parties arising from their use of the Service or violation of these Terms.

The operator may modify or terminate all or part of the Service without prior notice.

These Terms may be updated as needed.

For material changes that significantly affect user rights, the operator will provide at least 30 days' advance notice via the Service or by email to the registered email address. Continued use of the Service after material changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, United States.

Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.
